I was never written up previously for my performance, yet, last night I was fired on the spot? My employer said it was due to performance???And I live in one of their properties, once they fired me I was told I had to move out in 45 days??? Never had a lease violation, always paid my rent on time, no resident complaints, aside from the fact that I will seek out an attorney, are you entitled to unused vacation/sick days??? The year just started, however, am I not supposed to get those unused days payed out to me.

What do you mean by protected class? I feel like I was hugely wronged, it is a fact that my employers stretch their employees ( many will attest to this ) have some work at other locations and asked not to punch in, I'm salary, at least I was. I was running a very large apartment property, over 75 units, when they promoted the leasing agent they never replaced her, hence leaving me to do the added workload myself, when they made my FT engineer PT I once again was lopped with more responsibilities, I was stretched like others.

If you are a protected class then get a lawyer, you'll never have to work again; if you are not then just find another job (if you can) because you're screwed.

Do you have an employment contract? If not, and if you live in Illinois, you are considered an "at will" employee. That means your employer can hire or fire you at will, without reason. Try to get the "performance" issue in writing. Also, if you can prove discrimination via age, gender or some other "legal issue", you might have a legal argument. You may or may not be entitled to unused sick and vacation days. Your lawyer will probably be able to answer those questions. Document, document, document. Good luck.

Instead of going to your office to ask about your perfomance review...go to the "central headquarters" Human Resources. You should be given an annual review and a COPY of your review. If they gave you something to sign make copies and keep it on file for times like these. If you are covered employee, they cannot fire you with just cause. If not, then you can be let go at any time. Also request a copy of the review if you never received it and go to or call your previousl employer HR to request a copy of your review.
If nothing works, seek an advocate for employees rights. It might be discrimination.

In America, companies have at-will policies, which means that they can fire you for no reason (as long as it's not motivated by a protected class of discrimination under Title VII).
You probably won't get your sick days paid out to you, but there's no harm in asking/negotiating.

Contact you government Labour office. All jurisdiction have different laws. How long were you employed there? This might be a violation of rights. Pursue it, You have nothing to loose.

Some companies pay unused days, some don't. Do they have a written policy pertaining to this? Yes, please get a lawyer quick...you've been wronged
