my friend took one of my checks thats was made out for 153.00 to my phone company he took it and scribbled over the name and put speedway on it and was able to cash it their he bought 3 50.00 giftcards when i turned it into the police i didnt know he was the one that did it , "what im asking is what kind of trouble is he in"they didnt take him to jail and he admitted to it though he has not apoligized to me yet

im not worried about him hes a single dad with a 3 year old boy they dont have much and if he goes to jail hell lose his son to a foater home were the people will proboly just rape him or some crap

First, this is an ex-friend. This is not the same thing as the friend needing a pen, and taking a cheap Bic pen...this is a cold hearted thief...and proabably a liar at the same time.
This is probably a misdemeanor, not a felony, and he/she could face some deserved jail time. Check with the police department and find out what the status of their investigation is and if you have to sign anything to place formal charges. Do you know if the "friend" has a problem (drugs/booze) that might have been the root of this act? Not that that's a reason to dismiss it, at least this would tell you why it happened and if it is the root of it, then it's just the beginning of worse things to come in the future.
Did your 'friend" at least pay you back?

It's considered theft regardless. Did you press charges or did the police press charges on him? If no one put any charges on him then nothing will happen to him. If there is charges he will have to go to court were you will have to testify and if he has a clean record will have to pay the money back, fines and probably probation. By the way this isn't "much" of a friend. You might want to talk to an attorney because speedway had no right to cash that check since it was scribbled on and it was a third party check to boot. There might be some litigation against them for this.

It does not matter where you live .. but one thing for sure this person is not your friend .. A friend wouldn't steal from you that way just to buy gift cards . Im sure he or she won't appologize and if they do I doubt it would be genuine ...to actually take a check made out to another person , change it in that way and cash it .. no sorry a friend wouldn't do a friend that way ..
oh and one other thing .. Speedway should be responsibe for this too , how can someone cash a check signed by you with out any ID ??
one last thing ... you must be a good person to worry about whats going to happen to that theif ..

Get rid of crappy friends who will steal from you.
Have a serious talk with your bank/bank that cashed the check. They CANNOT cash a check that is obviously forged (scribbled).
Think about this: Should a kid grow up with a father like that? Why make more criminals?
(kids don't get raped in foster homes, where did you get that?)

Ummm, your friend is not your friend. He's a thief who ripped you off.
The crime is relatively minor; he probably won't get jail time (it's not grand theft or armed robbery).
Forget the apology, dump this jerk and be happy it only cost you $153 to learn your lesson.
