And is this technology patented by Apple?

It DID have a scroll wheel.

It did have a scroll wheel, but it did not have the new click wheel. What this basically means is that the Menu, Pause, Skip Left and Skip Right buttons were not embedded in the scroll wheel itself, but were actually placed in a ring around the scroll wheel. I don't know if the original scroll wheel was patented by Apple (I sort of remember having seen it used on other players, but that could just be that they stole the look, but not functionality, of the scroll wheel), but they do certainly hold the patent on the click wheel.

as far as i can remember 1st Generation iPods had scroll wheels. No idea if they are patented but probably. you could try inventing something using it and see if you get sued?
