There is a Defence of mistake available in English law. I suggest that you consult a Solicitor and try to get him to brief a Barrister. GBH with intent will be tried by jury and carries a heavy custodial penalty, but a good Barrister may be able to get the charge reduced to a less serious indictment.

Guess his next girlfriend will be Bubba then - good. People like this should be locked up for a very long time. I don't care what the rest of the question was - no-one has a right to be violent to settle any kind of dispute; nor do they have a right to take the law into their own hands. If this animal had a problem with someone, he should have taken it to the police or the courts.

Let's hope they throw the book at him!

The mistaken identity is neither here nor there, as this is a case of transferred malice. It seems clear that he intended to injure A very badly, inasmuch as he hit B hard enough to break....what was it? Your question itself breaks off at that point!

I am not allowed to injure you and then say in my defence that I didn't think it was you: I thought it was someone else and that someone else was the person whom I believed I was injuring. Your ex-boyfriend is in big trouble. Be glad that he's your ex.

He's screwed. Doesn't matter who he hit, the fact is he hit someone. He could have been charged with GBH even if he'd hit the guy he was intending to. Tell him not to be so quick off the mark next time.

Good. He should be charged. Anyone who hits another person in anger should be charged. That's why they make laws to protect people. Obviously he's about a sharp as a marble......HE DIDN'T EVEN HIT THE RIGHT GUY. I'm glad he's your EX boyfriend or maybe you would have been next.

Don't know what the question is, but if he's found guilty it'll mean a prison sentence. As the first reply says, I'm sure you're glad he's an ex!

You are a lucky girl.
Forget him.
Fighting is only acceptable when there is no alternative for self defence.
