I know that there can be a buy out but how can that be regulated and by who? Also, how can a property sale be forced? Any advice or links, etc would be very very appreciated.Thank you.

If the couple cannot agree on how to split the property then advice can be taken in a court of law where a judge will award accordingly.

But just remember - a share of the property can also include a share of any debt, ie outstanding mortgage or loans that may have been obtained prior to the filing of the decree.

Any property seperation made pursuant to a divorce is then written down in a court judgment. That judgment is the "order of the court." If the order is not followed, it is contempt of court. The penalties for contempt range from fines to imprisonment. Property can also be forclosed upon and sold. Your divorce attorney can assist you in recovering the property you were awarded.

Real property is divided and awarded based on Marital Termination Agreements approved by the court, or in the case of contested real property issues, by Court Order. Any conditions of an agreement or Court Order are enforceable by the Court if the parties do not comply. See an attorney.
