The people detained in Guantanamo are just suspected of crimes and the US must validly explain their detention. Otherwise, they must be released because their detention is a violation of the provisions of the Geneva Convention.

The people in Guantanamo are prisoners of war, but since they are stateless enemies they cannot bear this designation. Therefore they are classified as enemy non combatants and as such are not subject to the rules of the Geneva Convention. They are foreign enemies so therefore they have no rights under the Constitution. They are entitled to humane treatment which all accounts by all who have visited Guantanamo attest that they are receiving. The detention at Guantanamo is subject to military tribunal and as the detainees are sorted out and found to have no relevant information, or do not pose an additional security risk they are released. Mark that, released! Many people have been released from Gitmo, but interestingly enough our media refuses to report that part of the story. I wonder why? Now your heart can bleed for them all it likes, but for me I would rather see these people detained until investigated rather than release to fight against our soldiers again. They legitimately can be held until the end of hostilities just like POWs. If after that point we choose to continue to hold these people without benefit of charge I will protest against it, but until that time it does not bother me a bit that they are locked up. Would you prefer we treat prisoners like the terrorists do, because I am sure we can locate a Headsman and an ax.
jim c: name just 2 United States citizens who have fallen victim to the Patriot Act. Provide evidence because specualtion just doesn't do it. I don't like the Patriot Act very much at all, but I like malcontents who spin the truth even less because propaganda is dangerous no matter what side it comes from.

They are accused of a terrorist act. That is why they are being held. They will have their trial, and day in court, but until then, we do not allow suspected criminals to run rampant around our country in case they are guilty. It is the same for any suspect of a crime, any AMERICAN citizen, as well. They don't have to be proven guilty of a crime, to be held in a jail. Which is what Guantanamo is, for these suspected terrorists. America does this, by LAW, to keep their people safe, from possible harm, by those held. It is JUST, and SAFE for innocent Americans, that these folks be held until they have a trial. They can tell their stories to the judge then, but not before. THANK GOD!

The problem is not they are not sentenced. It's more that no one can hear about the individual charges filed against them. Sentence is second to charge and fair trial. Another thing to worry about is some of these people are released with little infos given to the outside world. If some of them were wrongly detained in the first place, it should be said. If some of them are released on the same whimsical bases they were restrained first, then chances are it's a sloppy job being done down there.

The last time I checked WE here in AMERICA were engaged in a WAR. And in a time of WAR ( even though most people don't believe we are actually in one because we haven't NIUKED the asses of those who so desperatley deserve it) WE are a SOVRIEGN NATION and don't really give a crap about who's in prision from a country that cannot see anything beyond it's own religion. BRAINWASHED FOOLS! NO ONE will be rewarded with virgins for the destruction of innocent life. The scary thing is if you take offense to this , that means you can read and understand ENGLISH , that also means you are probably in the US borders or Close by, or trying to find some way to get in. Which means. in turn that we here at home must keep our loaded guns by our beds at night as your people in do in your countries to insure that we don't have anymore of the crap here than you left from. Is It REALLY so bad here???!!!!!

Gitmo is a place were international rights are useless. And if I'm correct the US haven't sigh the Geneva Convention.
They are just there because they are suspected to be terrorists. So they being interrogated and I think also tortured.
The US are paranoïd and see terrorists everywhere.

Read the Un-Patriot act. They are not even charged with a crime! How can they go to trial without being charged!
This WANNABE Dictator we call Bush is the real terrorist! Do you know that the patriot act classifies someone who is "ALONE" as a terrorist and you can be held without due process?????
You People need to wake up!
The UN PATRIOT ACT has already been used against many AMERICANS who were not even considered terrorist!

because well over 3/4 of the people since 911 who have been placed in guantanamo were placed there because they were turned in by people who wanted the 10,000 dollar check the american govt would give them with no questions asked, no evidence or anything. it's america's VERY unique way of laundering millions of dollars and ridding the world of people who disagree with them by labeling them "enemy combatents"

Because they haven't been sentenced to anything. They have to be brought to trial first.
