I have too much debt-- and no income. I just got out of jail and am looking at at least 3 years probation if I don't get time served on my next court date. I will have to pay my P.O. I couldn't pay rent when I was in jail so now I'm three months behind on the rent. My checking account is almost -$3,000! I have two maxed out credit cards.... I am completely broke--- I can't afford a lawyer!!!! I don't know what to do...

If you file for bankruptcy through an attorney, the fee alone will be between $600-800.00 upfront. That's for total liquidation of all debts. You will not be eligible to file for a Chapter 13 until you are fully employed because you will have to make monthly payments to the US BK Court until they are paid in full. You can make settlement offers to eliminate penalty and interest, and most creditors will do that provided you have a good reason. I would recommend a Chapter 7, total liquidation. You can call the US BK District Court in your area and ask them how you can apply yourself. You have to get the proper paperwork and documentation together--proof of income, proof of assets, a list of debts, copy of any property liens or vehicle registration, etc. If you get any calls from bill collectors, tell them you are in the process of filing bankruptcy and that you do not want any collections calls. Follow that up with a registered letter to any offending collection agency or collector. They will put your accounts on hold for 90 days in order for you to pursue your BK.
As for Consumer Credit Counseling, you have to be employed to participate. They negotiate with creditors to reduce the balances and set you up on a payment plan. You pay CCCS directly. As for what USER JOE said, CCCS IS NOT FREE. You have to pay them a fee/handling charge. As for the $3K in the bank, they may grab that for your debts. (savings or checking) Maybe another alternative would be is to set up SMALL payment arrangements with your creditors. If you aren't working, they can't garnish any wages. Write to them to settle and most creditors will work with you because if anything goes to an attorney, they don't get a dime.

Bankruptcy will stay on your record for ten years, therefore making it difficult to get credit of any kind.

I recommend visiting "consumer credit counseling service." They will help you find alternative ways to get out of debt. Best of all, it's FREE!
