By Michigan law does a company have to post a job (internally and/ or externally) or can a manager simply give the job to whomever they want without posting and seeking others who might have the skill set? This action screams discrimination to me.

If your employer has a union, the job posting procedure is in the contract, and depending on how it's worded, the job may go to the "senior qualified employee", not necessarily the most senior.

On the other hand, an organization without a union usually tends to follow the Golden Rule - "Whoever has the gold, makes the rules." In short, there is no law that dictates to an employer how a particular position within the organization should be filled. In these matters, management has wide discretion, and in most case makes a sensible choice. There is no doubt that in a few cases favoritism creeps in.
