she changes drop off and pickup locations, doesn't help with transportation, keeps my daughter from calling/emailing me, tells my mother i don't pay child support, tells me i'm not the dad and just makes stuff up, then thinks it's true. my lawyer strongly advocates not going back to court. is it time for a new lawyer?

Yes, get a new lawyer. That would be the best place to start!!

First of all if she is changing the drop off and pick up locations from where the court set it up she is in contempt of court. Take a friend with you to the pick up point set by the court (for a witness). Keep all your records of your child support. Get yourself another lawyer and inform him of all that is going on and give him all your records (but keep a copy for yourself). Go back to court with your new lawyer and all your evidence and witness and if your lawyer is any good he will present it to the judge and have her fined and it will not be good for her. I've been there with my Grand-daughter and her mother and grandmother. The Mother was fined very heavy for the contempt. We also had a voice activated tape recorder to record some of the awful things the mother were saying to us. Just remember your daughter is confused becsause she wants to beleive her mother and really doesn't know the truth. Hang in there and fight for your rights..Hope this helpd..

Oh bud!! I feel sorry for ya! My husband went through the same crap with telling his mom that he wasn't paying child support (which he does), and because we were late dropping his daughter off (reached in the car and slapped his head, pulled back the windshield wipers on the car, stood behind the car so we couldn't reverse. Oh yeah I know how you feel!! I say get another lawyer, only because she is keeping your daughter from you. If you are paying child support, you should see your daughter. If she is withholding visitation then I would definitley go through the courts. I wish you all the luck for you and your daughter!

the court system doesn't care they want the parties to work out their own problems, my daughters hubby has an ex who is the same way, creates lies, causes problems, and it never got resolved, every year or so she creates some more problems. my son in law has spent 10 grand on this, the ex's motive is to cause problems, that insures he will have to spend marital assets in court. every time u have to go to court it causes more problems. his wife continues to lie, and cost them money they don't have, and the courts do nothing at all with her. the ex is angry, upset, unstable, and the courts really do nothing to help things. good luck with this, but it is a long ongoing problem that never seems to get resolved, just when they thought something was worked out, she creates a new delima.finally they just stopped going to court, as every encounter with the courts cost money, every time the attorney had to go to court it meant a huge bill, and without any resolution at all.

Yeah it is time for a new lawyer and make sure your new on is making sure the ex abides by the court decree, that or you can get her for contempt of court on your own w/out another laywer. Just go to your local court house and usually they have papers for you to fill out plus set up your own date.

your attorney is right, you cant take someone back to court for being an idiot. if that were true, the courts would be clogged with them. lots of ex's do those things (male and female) and we all know its not right.

the court views this as petty and wasting their time. they hate it.

save your court battles for the serious stuff. if you are going to take her back to court (for another court order for lets say... 'no disparaging remarks made to child about parent'), then the court order isnt going to be followed anyway.

but it is your right to try. tell your attorney this. tell him/her that you want a hearing and a court order (or current court orders to be enforced -an enforcement hearing).

you will find out if it is effective or not.

sounds like you really need to go back to court and then even get a legal guardian for the child involved.(this is actually a lawyer that represents your daughter)

Yes, or make the old lawyer do his job and get your Order enforced! If you owe him money, stop paying for awhile. It works every time!
