I received judgement on my account. However i was never served papers, so I am filing a motion to vacate the judgement. I live in cook county, IL. What happens if my case is in fact overturned and the judgement is vacated? Do i still owe the debt?

Judge can issue a judgment against you...........
If any attempt made to locate you failed..
judge can decree.

If you received a judgment against you, then you have been "served" papers via the court. A post-judgment motion to vacate judgment will be treated as an appeal, and most likely denied unless you can prove fraud upon the court. Once a judgment is issued, nothing need be immediately done to collect however, they will need to file a Motion for Writ of Attachment Order after judgment against you to attach your bank account, vehicle, wages, or other assets. You have certain exemption amounts from salary, house, vehicle, etc., that you MUST claim to the court within 5 days of receiving notice of the Writ of Attachment. In other words they can't take anything and everything unless you fail to claim exemptions from the Writ of Attachment. However, if the judgment is vacated, no you will not have to pay the debt. Depending on the reasons for vacating the judgment, they may have the right to re-file against you. Good luck!
