The more serious the crime, the higher the retainer, ie, misdemeanor or felony, and whether a full trial or plea bargin. For misdemeanors, DUI, that you will NOT fight and go for jury trial, about $3000-$5000 retainer can be expected in most states. If you know you are guilty, for example they have a DUI breath test, video of you failing the sobriety test, several witnesses, etc., then don't fight it, it will just increase your costs AND get you more jail time, fines, longer probation, etc. If you plea bargin, the attorney will be necessary to assure you are really getting a plea "bargin." However, sadly, the more you pay for retainer the harder the attorney will fight for you. Good luck!

It's really up to the attorney. Criminal defense trials take a long time and use up a lot of billable time for the attorney, so, anywhere from $5,000 to $25,000 isn't unreasonable, depending on the seriousness of the offense and your own financial status. But, the retainer amount is entirely up to the attorney.

ETHICALLY, an attorney's fee, or retainer, should be based on the seriousness of the crime, how many hours he/she and his associates have to work. Also, the bar association assists in establishing standard fees, and most attorneys charge by the hour.
