They can take the picture and not erase it and you can't do anything legally because it's "he said, she said"; HOWEVER, if they post, print, publicly display that picture then you have legal recourse for defamation of character or any number of issues. You would have had to sign a photo rights release for them to publish it in some manner.

Press charges? No. That refers to filing for a crime and only the Gov't (police, etc.) can "press charges." File a law suit? Yes, anyone can sue anyone for anything, but that doesn't mean they will win. If the picture was taken in a public place, ie., where if seen on the street, that is ok to "take" the picture. However, it cannot be used for profit or commercial purposes without you consent. If it is a newpaper general photo, it is ok to publish, but cannot be used to insinuate a false implication - ie for example that the picture is of some one in front of a bank that was just robbed implicating the person in the photo, etc. Any defamation of character or interference with a business relation, can be actionable in civil court. However, it must be clearly false, because the truth is an absolute defense to defamation (spoken) or slander (written or published) unless it also damaged your job or business.

What are the charges? You see, the simple act of taking a picture is not illegal. If they put in on their website and use it to advertise the website without our permission or are using it to spread lies about you then, that's illegal. But otherwise you're out of luck. Was this a 'dirty' picture? If they spread it around and it hurts your career, you may be able to sue for damages.

you can press charges to anyone and even for no reason, but will you be sucesfull when it comes to cort?, if you are in a public place you are subject to public exposure, however if the pictures aim your private parts could be consider to be with obscene intent, that will be illigal or if it is taken on your private property could be consider stalking or violating your privacy.

But his question was can they post it on the internet...and i have seen many people getting posted on youtube and being made fun of....and im not sure if they can be sued or not....i guess they could be....by the guy posting the website......so i the your answer is yes.....and i don't; know what the website is...because i don;t know who you are....hahahah

I am afraid that with camera phones and watch cameras and spy cameras on toy cars and things like this, privacy is no longer an option. As long as they don't sell your photo you cannot do anything about it.

If you are in public, somebody can take your picture and they can use it for EDITORIAL purposes. They can NOT use the picture without your permission for COMMERCIAL purposes, nor can they use it in other illegal ways.

Like Paul said. As long as they are not peepin' in your window to get the picture, they own it, not you.
