but he didn't actually kill them. He put them into the situations where they would have to do something in order to survive, if they didn't do it, obviously they died by the choices they made. Even thou he put them in that situation, they had the choice to get out (in one way or another)

Sorry, your wrong. The man would be charged with far more than murder. First he would be charged with unlawful detention, possibly kidnapping, conspiracy to commit murder, assault, conspiracy to commit assault, disorderly conduct, battery, reckless endangerment, reckless endangerment with a firearm, reckless endangerment with a deadly weapon....etc, etc. This is not a complete list, but not only did he commit acts that would warrant these charges but a good district attorney would find many more and charge him with these also. This is the way our legal system works, bury them in paperwork. This method makes it not only harder to mount a legal defense, it also gives the da. a point from which to start to plea bargain. I say the D.A., which I am sure someone will tell me is all wrong as it should be the defense attorney that looks for a point from which to plea bargain. The reason I say the D.A. is that our legal system is not about justice at all, but instead about making money, making a name for oneself, and finally, getting re-elected.

I never saw the Saw movies but a person who is involved in a felony criminal act and if in that act someone kills someone and is charged with first degree murder, they ALL can be charged with first degree murder. Each state has different laws

Haha, depends - if the police watched the movie, and the movie was TRUE. Then I'm sure he'd get assisting murder, aiding and abetting a murderer, and more then likely a slew of other manslaughter related charges.

However, 1st, 2nd, and 3rd degree all relate to DIRECTLY killing a man.

1st is pre-emptive, a plan was concieved and the person planned on doing it before hand. 2nd is impulsive, spur of the moment, and third degree is defined as, and I quote, "all other murder".

No.Since he is clearly insane he would likely be locked up in a mental hospital somewhere.I doubt a prosecutor would even try to bring murder charges against Someone so nuts.

niether. 1st degree would be when it is planned and set up. 2nd degree would be out of rage and in the moment. 3rd degree I suppose would be cercumstance like irresponsibility operating dangerous equipment or drunk and driving somewhere and you run them over. but even those examples could be argued. and call manslaughter.

It would be first degree murder because the intension of saw for the people was to die if they couldn't preform the tasks for him. or volutary manslaughter.

I believe he would be charged with pre meditatted murder, because the murders are planned and I believe that is 2nd, I'm not really sure.
Awesome movies though, I love them!!

No he would be charged with first degree murder.

What he did is equivalent to handing someone poison, putting a gun to their head and telling them if they don't take the poison and kill themselves you will shoot them in the head.
