Why is abortion legal, but yet someone other than the mother who kills an unborn baby can get charged with murder?

Rick-Ok, say that is the case. Then how come I just don't get charged with assault for killing the unborn baby? After all, I just "removed" a part of the mother. No different than cutting off someone's ear, for example. That isn't constituted as murder.

The makers of the abortion laws do not believe that the fetus is a human until it is actually born, therefore their logic is that an abortionist is not taking the life of a living being.
When someone is charged with murder of an unborn child the crime is that they have taken a life in progress, the murder of a future human, a life, that by the woman's choice, would have been allowed to fully develop into a living being, thus terminating the progress of life.
Because the law allows the woman to decide whether the fetus will continue to develop, only she can decide whether it should be terminated.

Many people point out that those laws that allow a murder charge for the killing of an unborn baby were passed by those who are against abortion to undermine abortion by creating this logical fallacy.
For example, the federal version of this law was passed just a few years ago with strong support from the anti-abortion wing of Congress. Democrats in Congress protested that the law would be brought up as an anti-abortion tool.
Your question proves them right.

It appears that only a few are understanding your question about the hypocracy of one person killing a fetus is "choice" while another doing so may be "murder".
It is difficult for those on either side to only answer the question asked without offering their positon on abortion on demand.
This is one of the best questions I have seen.
It is also interesting that the media uses "fetus" for the unborn involved in abortions yet "unborn baby" for those who were killed otherwise.

Because:
Legally, a fetus isn't considered a person until it is 24 weeks gestation (6 months) in most all states - an abortion can't legally be performed after 12 weeks of gestation (3 months). If an abortion is performed after 24 weeks, then murder is the case.
Abortion is legal to keep it regulated. You honestly think making it illegal will stop it? Why don't we ask all of those 16 year old kids out drinking on Friday night? Or all of those people out smoking pot? How is that all working - making it illegal to consume alcohol under the age of 21 and making it illegal to smoke pot/consume illegal narcotics? It won't stop it - making it illegal will only make the situation more dangerous.
You have your right to not approve of abortion. You have the right to protest it, and you have every right to make sure none of your money goes to support a place that performs them. But if you are REALLY dedicated in stopping abortion, then go educate people (mainly the kiddies in school having sex) on the dangers, effects, and the dispute of it. Go to the schools and show them the pics of the aborted fetus. Don't come on here, sitting in the comforts of your home in front of your computer and cry about how "horrible" it is that everyone doesn't subscribe to your point of view.

Because of "foot in the door" laws. Anti-abortion people cannot get abortion laws passed because of the constituion, so they come up with these laws that charge you for murder if you kill someone else's fetus. It's a way to get their "foot in the door" so to speak. They are trying to create hypocracy where there was none before. But abortion rights supporters are pragmatists, and dont' generally oppose these laws because what's wrong with giving a murderer another charge to face?

Good point. Something to think about. However, I'm sure the bleeding hearts will give some lame excuses on this. Also, I don't understand why Libs are for giving terrorists rights, and whinned over Saddam's death, but will kill an INNOCENT, unborn baby without a second thought.

Because the Supreme Court of the United States ruled that it is an individual woman's decision to decide if the fetus is a part of her body or not. The moral issue is another matter - this is a LEGAL issue - not everything that is legal is moral. Example: O.J. Simpson.

Because conservatives have made limited strides on this one.
The concept is when you murder a pregnant woman, you are stopping the child from getting a chance to become a child.
