Paternity test, and then you can have him removed off the birth certificate and put the real father on as well as change the babies name, but the father(Biological) has to agree!

Making name changes:

To change any part of a baby's name or any part of the parent's names, a court order is necessary. The original document is sealed and a new document is created (example: Bryan Hernandez changed to Bryan Lee).

The entire process may take up to a year to complete. Begin by contacting the clerk of the Superior Court and ask about the name change packet. Once you have a certified copy of the order to change the name, file it with a completed Amendment to Reflect a Court Order Change of Name (form VS-23. A fee of $20 must be accompany the form and includes one certified copy of the amended record. All other instructions and the mailing address are on the back of the form (same as shown above).

I think that if you do it in the first 12 months you do not have to go through all the crap to do this, but I'm not sure. Contact the Office of Vital Statistics near you for more information.

You will have to retain a lawyer to see if you can do this. Legally, you can name your baby whatever you want, including giving him/her a different last name than yours or your husbands. This has to be done before the birth certificate is filed. If you want to change your baby's name you will have to file for a legal name change for her and there may be some trouble with legal issues if your husband is not the biological father of the child. Consult a lawyer as to the way to handle this situation in your state. Your husband will likely have to sign the papers as well since he is listed as the child's father. Is he OK with giving the baby another man's last name? If the baby's biological father is not an active part of her life but your husband is, then it would be respectful and appropriate for your daughter to have your husband's last name since he will most likely be the father figure in her life. A father is much more than the sperm donor.

I found this information:
legalzoom.com- they'll do it for a kid for $165.00, and you'll get documentation in 2-3 days. They'll do the whole thing online, and apparently you save $773.00 off of working with a lawyer.

inamechange-name change kits that are geared towards specific states. You have to find your state (warning-list is small) and use their specific information

1stoplegal.com-has a full list of states plus D.C. and contains an accurate kit for each state, but I think you have to go to wherever you would change the name yourself, as opposed to an online option.

namechangelaw.com-diy forms from every state. For $39.95 you can do it yourself, and for $99.95 they'll do it for you.

I found all of these-and more-in a Yahoo search-changing names. Do that if you need more info. Just remember to use minor forms and find info for minors.

If her father has not waived his parental right, than go to your county courthouse and file for the change. Otherwise, if your husband is willing to be primary father figure, you might as well keep his lastname

You have to get a blood test first than go to the court house and get the names changed.
