We recently found out that my fiance has not be legitimated. We do not understand what this means and cannot afford a lawyer. I have looked online but really haven't been able to find anything. Does anyone know what we can do?

It means she was born out of wedlock; parents were not married at the time of her birth.

I haven't heard that term used in a while. Children that were born out-of-wedlock used to commonly be referred to as a mom's "illegitimate" children. I don't know if there is a different "legal" term that has a different meaning (I'm not a lawyer), but several years ago, the term was common.

Come to think of it, I have heard of cases where the father was stated as "unknown" on a child's birth certificate. I can think of several reasons why this may happen, such as in the case of a pregnancy and childbirth by an unknown rapist; but I have also known mothers to deny knowledge of who the child's father was.
It was usually when the mother applied for public assistance and wanted to avoid the legal hassles of the state attempting to recoup funds from the child's natural father. There have also been times when the mother genuinely didn't know because she had been having sex with multiple partners.

Maybe the term is referring to the mother not acknowledging or not knowing who the birth father is...

Usually it means that the person was not conceived in marriage. So the father can file an affidavit or fill out a form through your state's vital statistics office to confirm legitimacy and have his name added to the birth certificate or maybe adopt her.

if your fiance's father did not marry his mother or if he was born first before they were married that makes him man illegitimate child. therefore, he would need to go through a court procedure to make him a legitimate child of his father.

even though he is the father, he is not recognized as the legal father on the birth certificate. Under fathers name, it will say "unknown". You guys need to fill in the blank. This should have been done at the hospital though..

Has this guy been married before? He obviously has some kind of unresolved legal issue. Does he know what that issue is and do you even know?
