I just want to know if the ish hits the fan will I be held as the legally ultimate responsible party for shipping a product that is not declared or is falsified even though I had advised my company on the possible legal consequences of doing so? Basically I would be not declaring something that ethically I had expressed is illegal to do so. Has not happened yet but I keep hearing the possibility of that suggestion in the air by the powers that be. Anyone with specific knowledge and information would be appreciated not just general ideology on the topic. Thanks

Contents of shipments must be declared under the law. Thus, the shipper and the company transporting the cargo are jointly liable if the contents are found to be not declared when inspected upon arrival in the destination.

If you can prove that you gave them such an advisement it is highly unlikely that you personally can be held liable. I suggest you write them a certified letter advising them as such. Keep a copy for your records as well as the return receipt! Also, make certain that you are NOT the individual who packs and ships the item. Let someone else's hands do the work.

Of course! If you are the shipper and make or advise that a false declaration be made, you will be liable.

If you're the one that ships it, you are the one responsible. Just because a boss tells you to do it, doesn't get you off the hook. I would refuse to do it.... illegal is illegal.
