Has any community in the USA every tried to have an HOA removed from a new development?? and/or have they ever succeeded??

yes you can we did in colorado we all voted and signed to get rid of the nonsense hoa

You can try all you want but the benefits of an HOA usually far outweigh the benefits of not having one. So, you could try to get enough people to revolt against your current one, but then you all would end up starting another one. Besides, most HOA's are democratically run and if you are getting hassled becasue you keep leaving your car up on jacks or you take out trash three days early, then no one will obviously vote to get those removed. HOA's can be brutal, but if there is a single problem that you have with yours then talk to whoever's in charge and state your case and see if they will make an exception for you.

There are usually covenants that set up the HOA and keep it in place - these are set up by the original property developers. I suspect after a number of years you might be able to argue that the covenant is overly restrictive, but when the property is relatively new, it's unlikely that you can vote the HOA out of existence.

Its possible but varies and thats often made impossible when its set up. Interestingly enough the HOA board usually (not always) can. A good friend of mine became the head of his HOA board and then eliminated it entirely. Regardless it requires quite a bit of schemeing or even campaigning.

How any American has allowed themselves to be arbitrarily ruled over by HOA's is beyond me.

They're the anti-thesis of everything America stands for.
