Prosecuting attorneys often make big threats in order to encourage plea bargins and avoid costly trials. The defense attorney can counter with other options to reduce fines, probation, etc. Do not take the prosecuting attorneys threats without reviewing with defense attorney. Is the weapon a firearm? Then yes, 5 years prison time for most firearm offenses.
