If the driver can prove that he wasn't the offender, no worries, The company will have to provide the information about the driver, if the vehicle was a HGV the company should (by Law) have tachogragh charts for all drivers (this should therefore by definition cover all vehicles) for the previous 12mths so they would be responsible for identifiying the offending driver

My friends dad had two identities so he could drive the truck long enough to make some serious cash, he did OK till he hit a deer near Crianlarich and Mac Plod found him trapped in the cab in a ditch with both sets of ID on him. There are a lot of nonexistant phantom drivers out there,

we are supposed to be innocent till proven guilty if proven company is just blowin in the wind
