I recently lost my husband of two days. The Federal govt., SSA says I am a widow and sent me the survior/spouse death benefit. However, NYS says I can not collect widow's benefit because I was not married for the 9 months previous to his death. We had lived together 33 years, but Common Law does not exist in NYS. Do I stand a chance with an appeal to Soc. Sec.
Why does the Federal Govt. not take over rule the state on a federal program.

Did you get married because you both KNEW he was going to die? If you did then you are NOT entitled to his benefits. They have laws to protect the future of SS. There are a lot of people that are married legally for years that get squat when their spouse dies. This is another reason that people should get married instead of just living together. It does not matter how long you lived together.

I would be fighting that will all my might. I thought it didn't matter how long you were married, just that it was a legal marriage.

I would fight this one if you have proof you all lived together before this-33 yrs

I would appeal it. I think you were married no matter how long legally.
