I currently live with my husband but i think we are fixing to get a divorce. The home we live in now, with our one year old son is a rental home. I feel like it would be easier for him to leave than for me and the baby to have to leave even though i am the one who is wanting out of the marriage. Because this place is what my son knows as home. Should i leave or should he? And what do i do if he will not leave?

If you're the one that wants out, then you need to leave. Your son will be just fine as long as you have a decent home for him to live in. My personal suggestion is to go live with your parents for a while....they sure would enjoy that grandson! Once you get your bearings again, then get your own place! Good Luck!!

Since you want out of the relationship, you should be the one to leave. Your baby is one years old so as long as you take things that are familiar to him the adjustment shouldn't be too difficult. Take the majority of his belongings, leaving a few for when he comes to visit his father. I think staying with your parents for a few months is a great idea if they have the room for both of you. If you are the one that wants out of the relationship, then move out. If you really cant do that, then ask him to leave. If he wont leave then you need to be the bigger person and move out!

He should move. It would be in the best interest of your child to keep him in a familiar environment and keep the disruption to his life at a minimum.

if he is a gentleman, he should leave. if not, you can ask your lawyer to negotiate it.
