had a child with my ex boyfriend, we split up soon after my DD was born because of his drug use. He has been in and out of jail due to drinking and driving, drug use, leaving the state while on probation. He was in jail when my DD was born and for both her birthdays, he recently got out of prison a few months ago and within a week he was in jail for leaving the scene of an accident and he was also drinking. He has another court date coming up for that.He has made a few support payments, and we have an agreement for him to see he every sunday, we agreed on this because of his work schedule. Alot of those time he has been late or he dosen't show up at all. I am engaged to another man now and we have moved our plans around for him more than once. I have told him he need to start being on time and that we aren't going to accomadate him everytime, we have stuck to that and now he is saying that he is going to take me to court to get scheduled visitation With his drug use what will happen

W/ his record, I would think a judge in your state, (any state for that matter), would find him harmful to the welfare of your child. Even if he does manage to get visitations, he would have to have supervised and I would mandate that he has to drop a UA every time he picks her up, and if you can swing it, when he brings her back. That way you know he isn't taking her when he is high, and you know he hasn't done any when he has had her.

Trust me on this, a friend went though something similar. Get a good attorney NOW to safeguard yourself and your child. You need to press upon your attorney that you fear for the safety and well being of your daughter. You really need to start keeping a notebook of the times and dates, and the conversations with him and when, where and if he shows up. Good luck.

With his record, any visitation granted would have to be supervised. Wait until he doesn't show up for one of these visits. Wow.

What a winner. I pray you have chosen more wisely the second time.
