well I tell you for what I know. I'm in the military and we a have a regulation that state "Don't ask, Don't Tell" that way everyone is cover you can't ask nobody if they are gay or not Or if you are gay you can't tell no one. I guess that many companies have the same policy with a different name and yes I guarantee you it will cause you many trouble. Many times people say here that if you want to know if someone is gay just ask them, but sometimes unless you a have a pretty good reason for asking or you been getting sign and signal to stay out of trouble you shouldn't ask. Sooner or later you'll find out, so don't worry about it.

YES, it could be construed as sexual harassment. These types of questions have no place in the work force. I fired someone for asking another employee if he was gay because the employee felt that the other had crossed the line and had created an uneasy work environment. The other employees felt the same as I did

If he is gay at work he is also gay at home. So get to know him away from the business enviroment. Be diplomatic and you'll find out if he is soon enough.

Yes, actually it's not only concidered sexual harassment if you ask, but depending on what state you live in and the company's policies, if that person actually "outs" themselves their job could be in jeopardy as well.
It's simply inappropriate on all levels.

Yes. I wish there really was "gay-dar", but there isn't, and you can't ask, either. If you're interested in them, get to know them. Their orientation will become apparent eventually.

Yes, sexual harassment policies are ambiguous of if that person gets offended you are in trouble.
