The obvious answer is to not have one.

Although you might ask him what he might want inside a pinata - doesn't have to be the traditional candy. You can put pretty much anything you want inside one of those, and he might think it's kind of cool to have a customized pinata with whatever he wanted inside to give to his guests. Coins always add to the excitement - water pistols would certainly insure the rest of the party was exciting - a small package for each guest, with the name of the guest on it with a small something inside - certificates that can be redeemed for something

Lots of ideas - see what he comes up, and that might make the pinata idea more interesting.

And if you've got someone in the area who can custom make a pinata, so that it looks like someone you know - probably a bad idea to make it look like a teacher at their school - but that can also add to the pinata idea.

Get him one anyway. He's only 12; how does he know what he wants. Besides, when his friends find out that he's having a pinata at his party they won't show up and you'll save a ton of money on food and party favors. He'll also loose all his friends and they won't be bugging you to spend the night or take them to the movies. Your life will be so much easier, except for the time and money you will have to spend on therapy for your son.

If he doesn't want a pinata for his birthday then don't get him one! It's his birthday so find out what he would like to do. Maybe he'd like you to take him and his friends for a day out to the movies then burgers, or to a water park, or an 'adventure park'.
