He was trying to figure out the smell you left from the day before of what you have been eating. Hes a fart sniffer.

By legal definition, you could not claim sexual harrassment based on this alone (though it could be used against him in conjunction with other evidence in a suit). Sexual harrassment is defined as repeated, unwanted advances that you have discouraged, or as the instigation or suggestion of a "quid pro quo" arrangement. Still, I'm sure this makes you uncomfortable. If your boss is not the head of your business, I would go to higher-ups and let them know about it, stressing that you don't want them to take action or ask him about it. This will at least give you credibility with them later if he continues to do things that are unsettling to you in the future.

Im not an attorney, but this does seem a little strange. If you work for a large company that has an HR dept. I might consider going and at least notifying them of the boss' activities...this will help you if there is a pattern of sexual harrasment in the future.

If he sniffs the chair at the same time as you're sitting in it, which will be sexual harassment. also, you may evaluate the prospect that it is not basically him. perchance whenever you go away the place of work, everybody who works there strains as a lot as sniff your chair. you should have an public sale for human beings to bid on sniffing you somewhat of your chair. or perchance you should get a humorousness somewhat of taking your self so heavily, you undesirable compelled creature.

I do believe it would be sexual harrassment if you were sitting in the chair, but if you caught him sniffing it, maybe he has some kind of weird chair sniffing fetish.

Not one bit...unless somehow the chair was offended then I am sure someone at the ACLU will be willing to prosecute your boss and sue for a hefty sum of money that will take care of the chair in it's old age!

Wow. I wouldn't say harassment. He just might have an odd fetish. I would confront him, and if there are further incidents... then pursue reporting.

For some fun... put something really gross smelling on your chair one day. A spice or something you can put on the chair, without looking like it, so he can have a surprise next time he tries.

It certainly could be. He may well have a claim against you. Did you, well, you know....I mean... were you...did you..ah...clean yourself before you went to work yesterday... What I mean is, after that marathon you had the night before... you might have forgotten to ....ya know. So your chair might have smelled kinda raunchy. If you know what I mean. I don't think he should have to smell that. Just my opinion.

It is odd. But I do not think it can be sexual harassment if the person alleged to be the victim is not present.
