My fiance is in prison now for assault in the 2nd degree which is a class c felony, we are trying to figure out if that is a violent crime. If it is then he will have to spend a longer amount of time in prison. Please help me.

Yes, Krys, it certainly is a violent crime. Assault is an act of aggression, regardless of the degreee. And the time in prison will depend on the state laws governing assault in your state.

If he is in prison while the assault is committed, then he will be likely added some extra time to his sentence. Often a prison review board will decide that, but in some jurisdictions, the inmates must be tried for addional offenses, even if committed in a detention facility.

The charge is reflective of a violent crime....circumstances of the situation and your fiance's role in it determine whether or not he is seen as a violent person....if he acted in a violent manner in the commission of the crime than he will probably spend the max time in prison
