During on day time at day job, I call my manager of night my night job. While I was talking on my cell phone. My day supervisor was listening in. Obviously he hid himself. After I finish he step around the corner. Says I talked along time.
What do you think.?

Okay, I'm going to try to interpret this for everyone out there who speaks English. Forgive me if I get it wrong:

"While I was at my day job, I called the manager of my night job. While I was talking on my cell phone, my day supervisor was listening in. He had been hiding himself, and after I finished, he stepped around the corner. He said I had talked a long time. What do you think?"

If I did indeed interpret this correctly, then I would say, no, that's not illegal. It's usually against company policy to talk on a cell phone while at work. My boss almost fired someone the other day for doing it. If you were on break, and I mean actually clocked out so that the company wasn't paying for your time, and you weren't supposed to be working (you had permission to be on break) that's another story. But if you were clocked in, or were SUPPOSED to be clocked in, then hang up your cell phone and get back to work.

Depending upon your office guidelines, it may be against the rules to conduct "non-business related work/phone calls" during business hours...your cell phone or not. It was probably not the fact that you made the call, it was probably they felt you were not performing up to snuff and they're giving you a "head's up". Is a review coming up for you?
If it was during break time, tell them it's none of their business.

No, when you are at work you are on your employers time. Any personal activities (not work related) can be monitored and you can be disciplined accordingly. By law you are mandated only a 30 minute lunch and 2 fifteen minute breaks per every 8 hours worked. Unless you were calling on your scheduled break, you were on company time and your boss was within his rights to monitor every aspect of your preformance, including but not limited to, personal calls.
