You might want to consider getting another attorney. I have NEVER heard of an attorney advising a client to "let him have them." That's the worst advice he could have possibly given you. Of course your attorney told you that because it means more money for your attorney in attorney fees and fees for him to go to court with you and represent you. Your attorney is not doing you any good and he is just draining your pocket book. Do you know how hard it is to regain custody of your kids once the other parent has custody? It takes a lot of trips to court and alot of your money. Plus, now YOU are the one paying child support and you don't even have your kids - what kind of deal is that? Your ex has custody of them, so he gets out of paying child support, plus he gets to claim the kids every year on his income tax. Please consider getting another attorney - this attorney is doing nothing but collecting your money and giving you the shaft. Best of luck to you and I hope you get custody of your kids soon.

I'm not understanding. If you worked and he stayed home, that easy enough to show he lied--get your employer there to testify that you worked. If he stayed home, you hubby is gonna say he was the primary caregiver and not you----that could very well bode in his favor of getting custody.

It's much easier to get custody upfront than get it later--later if you want custody back, there has to be a material change in circumstances. If your attorney told you to LET your hubby have the kids and you would fight them later, you need a new attorney. You LETTING him have the kids is not a good thing for the Court to know. You need to sit down with your lawyer and find out exactly what his plan of action is.

I have gotten men custody of their children before and yes, the mom's pay child support.

It really shouldn't be hard to prove who worked and who didn't. Don't you have old tax records and such? Showing your W2s should end this discussion.

I don't know why you are divorcing, but if the kids live with him yes you should pay child support. Why do people always think that it's always supposed to be give the woman the children and give the man the child support responsibility? Some times it should be the other way.

My husband's ex-wife pays child support for their two kids. It doesn't matter who makes what, child support is paid to the custodial parent and is based on your current income - or potential if you quit a high paying job to avoid paying child support.

Nope - no way in hell I could be proved to be an unfit mother.

Seems very strange to me - he shouldn't be able to take your kids simply based on the grounds that you never worked. Most stay at home moms keep their kids after divorce... Judges are very reluctant to take a child away from it's mother without very good reason...

If you do get custody, treat your kids good. Don't take them for granted. Good luck.
