i got married in the churh & later on had a court marriage ,which is the best option to be on the safer side legally in the in case if i remarry,how is alimony worked out in both the options , my marriage is13months old, thanx for the previous replies

In order to get an annulment, you have to get a divorce first. It could take years to annul it.

An annulment means that you want the marriage to never of legally existed, and you owe each other nothing-I believe you can only do this withing the first year. A divorce means that the marriage has been acknowledged and the things that you share need to be legally split. If you are able to get the marriage annulled, there is no alimony b/c the marriage never really existed. I don't believe that you can have an annulment and a divorce b/c you can't divorce something that didn't really exist, and you can't annul someone you already divorced b/c you already acknowledged the marriage, so you can't later say it never really existed if you just acknowledged it....does that make any sense? lol

An annulment means the marriage technically never happened. Therefore you have NO rights stemming from the marriage - no right to alimony or part of his property. A divorce legally separates two people. The marriage still happened but now it is over. You still have rights stemming from the fact you were married. You can remarry following either a divorce or an annulment as both mean the marriage is no longer valid.

If by church, you mean Catholic, you need an annulment from the Vatican to remarry. Don't count on alimony in a 13 month marriage, and remarriage will end even that assuming you get it. Generally, an annulment is as though the marriage never happened, a divorce is the ending of a legitimate, consummated marriage. You need to see a lawyer, to protect your interests. You need to file paper legally under both circumstances, since your marriage certificate was filed in public records so will your divorce or annulment records need to be filed.

An annulment can be granted in two intances. Religiously, which is when a couple wants to marry in the church and one or both of them have been married before the church must first annul the previous marriages before they can be married in the church (they can still have a civil marriage)
A civil annulment usually occurs shortly after the marriage was preformed or if the marriage has never been consumated (the married couple haven't had sex). I don't know where you live but in the U.S. ALL marriages have to be legal even the ones in church. If not then in the eyes of the law you're not married and you have nothing legally to stand on if the marriage goes bust.

No, they're not the same. Annulment for sure is a total legal desolution of marriage. You must have a valid reason in order for your marriage to be annulled. Any conjugal properties or monies earned that you declare will also be decided in the court, custody of children will be decided upon as well. When your marriage is annulled, you can assume the single status or whatever your heart desires as your marriage is already completely dissolved...as if ..it's non-existent. However in divorce...it's also different...please log-on to divorce law websites fo rfurther info.

The court marriage is the only one you have to legally fix. You can go to your local county courthouse (where you lived as a married couple) and file for divorce. Since you don't have children it may take only 60 days. Talk to an attorney, perhaps you can file an annulment. An annulment is as if the marriage never happened at all.

In a divorce, the marriage ends yet continues to be on the books to be able to speak and in some religions, any remarriage might want to be considered adulterous.

legally you need to get the divorce. i think you were married too long for it to be annulled. but check with your lawyer to be sure. if you are catholic, you will have to get it annulment first before they (the church) will recognize any other marriage. even if you don't get the annulment, you can still legally get married if you are divorced it just won't be recognized by the church.

annulment is the cancellation of marriage and divorce is the dissolution (ending ) of a marriage. As divorce is not allowed among catholics and so they go for annulment.
