You're entitled to 1/2 of the residence and it's equity unless of course this property was purchased before your marriage by your spouse.

The 401k or pension you're also entitled to a portion but this all depends on what the laws are in the state you will be seeking a divorce in.

BEST thing to do is seek out a FREE consultation with a family law attorney and have your legal questions responded to from someone who knows what they're talking about!

No. Unless you have a pre-nup, you have full marital rights long before that. It's up to the judge. I mean if you marry someone then two weeks later want a divorce and your spouse is rich, then I'd say the judge may not go with your story.

as long as you contributed to the home
