ok my husbands ex wife who has primary custody of the kids just started working sometime in the middle of 06. last year we filed for his kids on the income tax because she was not working. can we file them again this year?

It depends on what is in the div ore decree. If it states that she is to claim them than she can but if she agrees there is a form ( unfortunately I don't remember which one so you are going to have to call the IRS to find out) that she can sign giving your husband permission to claim the children.

ok here where i live if a person does not support them for at least 6 months or they do not live with them then u cant claim them however if u have court papers stateing that u can then i think its everyother year like one year she can and the next he can and so on but both cannot do it at same time

Does it state that he can claim them in the divorce decree? If if is stated only every other year, then no, unless she tells you that you can. Even with her working only half of the year, she can still claim them.

Without her consent you can not.You may check with IRS.
