I voluntarily gave my husband custody of my daughter a few years ago and it was agreed to in court (NY). Now he lives in NC, I live in FL , my daughter lives with me and I don't know where to begin to get custody changed over permanently since NYS child support has been up my A** for the last 7 months even though she lives with me. Neither of us have the time to go to NY for court, does anyone know where I would begin?

Have an attorney draw up a Consent Judgment, wherein both you and your ex sign and agree on the new arrangement. Also, the attorney would need to state that the child has been in your custody for the last 7 months, and that your ex husband agreed to stop accepting child support payments.

If a Consent Judgment is signed by both parties, and your attorney, the Judge, more than likely will sign the Judgment with our your appearance. Then forward a CERTIFIED copy of the judgment to the NYS child support office. You should be clear.

I think you need to call the court in New York and explain all of this to them. Their the ones who know the answers (or they can refer you to who does.)

You go to a lawyer, then to court.
