Congress passed the "authorization to use force" which is as close to a legal declaration of war by Congress as anything since December 1941.

The fact is that war was never declared, Congress voted to fund a police action. War was never declared in Korea or Vietnam or Panama or Grenada,or Afghanistan or Kosavo. This president will go down in history for ignoring balance of power of the legislative and judiciary branches of government.

Congress did authorize war in the Fall of 2002, if you are refering to Iraq. Congress has no Constitutional authority to tell the President how to manage and fight a war.

Technically, he didn't declare war. Congress authorized force, but as the commander in chief, he sent troops in. Same as in Vietnam, Grenada, and Gulf Storm.

Bush fed erroneous 'intelligence' to Congress, (and the nation), to get them to buy the WMDs/terror threat story he needed them to believe, so they'd authorize funds and military action to invade Iraq and topple Saddam. Enough did believe him to garner the necessary votes/support.
An analogy: A man lies to a group of people about a business proposal, to get them to invest their money. They examine his well-prepared, phony proposal, believe that it's a good investment, and agree to give him their money. Later, they find out that he was lying, that he has spent their money, and they can't get it back. They have him arrested for a crime called 'fraud.' See how that works?
