Can anyone PLEASE help me.. I am trying to buy out my ex husband out of our family home. ( for the children) I have paid all house pmts, insurance and propty taxes since 2003. he is trying to counteract it by saying if Myself and the kids did not live here he could of received rent... And he was made to leave the residence by court order. My lawyer is ok but he is in devorce himself sooo I am trying all I can to get info. I have looked all over the internet . ANY info would soo so very nice. I do believe he is owed for when he lived hear but we can't agree on a price.... Thanks

He could have received rent? What does that have to do with the price of eggs?

Here's the standard deal---you pay him half the equity that accrued during the marriage if you want to keep it. He pays you half if he wants to keep it. Otherwise, sell it.

The fact that you made all the payments and taxes doesn't really matter--you received the benefit of that too.

Have a real estate agent come out and tell you the Fair Market Value of the home--look at what you owe--and bam--there's your equity amount. If you attorney is too caught up in his own mess to get that done for you, I'd suggest you hire a new attorney.
