i am asking for a friend near dallas area. He has been sepeated for 1 1/2 years and now getting divorced, he just doesnt know if he can be made to pay child support for the time of seperation, cause he gave her money during that time. but its not documented. any help would be greatful, thanks for listening..

I am not an attorney but I would think you cannot be made to pay child support if it was not Ordered by the court.

Maybe.was it a legal seperation?If so the judge can award child support retroactive to the time of divorce and without any receipts showing he was helping financially, he could get screwed. If it wasnt a legal seperationmeaning the seperation wasnt registered with the courts, then probably not cause even the seperation would be hard to prove Hope this helps some and good luck

Go before a judge and remind the judge he has a CDL and he is purposly under employing himself. THe judge will order him to find a better job. I know cause it happened to my ex. Also, even if he signs his rights away, he is still liable for child support unless they are adopted by a spouse. My brother signed his away and still pays child support. You can't get away from being a parent that easy. You can't just throw the kids away. All he is doing is saying he doesn't want anything to do with their well being and gives permission for someone to adopt. You best bet is to go before a judge, have him deal with the ex and then move on with your life. Don't let the dirtbag come in and out of the kids lives as he pleases. It only hurts them more. After they hit 18 they can do as they please. Good luck.

Not as I recall...Until the judge signs the deal they are still legally married. However. If he is paying her something. SOME judges will back off on hammering him in other places. Child support is a set deal though. Seems to me its 20% for 1, 22 for 2, 25% for 3 or more...I may be wrong but I don't think I'm to far off.

hey i live in tx and i hate to say it but yes they can. my ex just went through it .this is how it went they asked how long seperated and if he gave any money. i told them how long and how much money so they added up what he should payed and went from there.now if they lie then he may have to pay moreeven though he did pay. my ex was behind like over a 1000 and since i was honest they cut it down

I don't think so. Unless the kids were discussed in the separation decree.
