I worked for my brother for a week and he refuses to pay me. His company is owned by 4 men himself included. My brother drove me from Washington to California when the week was up and he refuses to pay me because he said that the gas alone was over the wages I was supposed to receive. Im wondering if there is anything I can do to get my money. I did not sign a w-2, as an employee I wasnt given one to sign. Does anyone have any suggestions that could help me get the money I worked hard for?

I actually discussed this with my parents and they take his side, they agree with what he said about the gas to bring me home. I also have a letter sent to me by him stating he isn't going to pay me due to his personal reasons.

You need money to live on, it either has to be SSP or benefits. Have you earnt enough to be paid SSP? If the employer states you are not entitled then you must tell DWP you are not. They will give employer a form to complete to satisfy them you are not entitled. He will either dig his own grave there, or prove you are not entitled so that the DWP can work out your benefits to be paid. At the end of the day the employer has a responsibility to deduct PAYE and pay the tax man. Of course if you are knowingly avoiding tax too you could also be in trouble....but not as much as he.....and what are you going to live on if you dont get it sorted?

Labor laws differ from state to state. You need to check with your state's labor and wage board to find out which, if any, rules were violated. Also check with the state in which your brother's company is based and if the job was done in yet another state, check there as well. The state I'm in, it's illegal. He made the choice to drive you to the worksite, it's his problem. It's also a violation here for him to employ you without filling out the proper paperwork unless you are considered contract labor (he still can't withhold wages though).

Take the owners to small claims court. If they are smart they will pay you before it goes to court.
If they take it to court, as long as you did not make any kind of agreement with them that the gas money was coming out of your pay, they cannot legally withhold it, no matter how far they had to drive you.

Dude, that's not an employer.

And it doesn't sound to me like YOU were doing HIM a favor, but HE was doing YOU a favor in giving you an opportunity to do something and maybe earn a buck or two.

Did you have a written agreement?
Was it actually violated?
Are you prepared to claim that as contracted income on next year's taxes?
Did you really work hard, or just harder than usual?

That is sad as I doubt it was that much money and he may lose you due to his behavior. I am sure your family will also find his behavior wrong as well. You learned something important about your brother.

That sucks that family would do that to you, sounds pretty disfunctiional to me.

sounds like you need to whine to your mother about it. That's probably the only way you will get it. However, there is no way it costs more than $500 to drive from even from Labrador to california, even in a semi truck. He is being cheap.

You should take him to court because he old you money and you didn't get it so take him to court. Or find another job and then quit.
