Situation(short version): single at home mother of three. dad hasn't seen them in 10mths. as of 1-07. no money from him since 6-06. found out for sure he has had a girl for 5 years that has bragged about expensive gifts and going out on myspace with him. she's 20 and he's 27. what legal action can be taken in the state of texas?

He seems like a deadbeat dad!! Go see a lawyer and there are plenty of lawyers who work pro-bono and get his ***!!

I don't see any signs of an over protective mother, but he's certainly a dead beat dad. You can't do anything about him having a girlfriend and buying her expensive gifts. But you most likely can get a court order for child support. And if he doesn't pay up, then you can have his wages garnished. Every state is different, so you need to talk to a lawyer.

My first question is this: Why is HER daycare provider coming to her home to do a "routine" home visit? I have never heard of this. I live in Michigan also, and have used day care for several years. Never once has my provider been to my home to do a routine visit. Those happen to the provider, not by the provider. Secondly, yes she can be reported to CPS and they can remove the children. It can be reported by anyone, not just her daycare provder. She is failing to meet the basic life necessaties that her children need. When she became a parent, she took on the responsibity of ensuring that her children had those needs met. My next questions is why did she wait to go for help until AFTER her utilities were shut off? Had she gone when she got the shut off notices (that are required to be sent out before a utility can actually be turned off) those agencies could have had contact with the utility company possibly extending the shut off notice until they could determine her eligibility. She should have taken that responsibilty before this happened. Now, I am not blaming her for getting into this situation in today's economy, but she should have taken a pro active approach to this instead of waiting until they were turned off and worry ing that someone is going to report her for not meeting her childrens basic needs. Melo- Has she reported the missed child support payments to the Friend of the Court and requested a show cause hearing/warrant?

Texas is a lot better than Missouri when it comes to Dead-Beat-Dads. I have to deal with my wife's ex. He waits 3 months then he pays the min so he can get by another 3 months. He did find a sucker of a girl to pay his back-support. I can't believe she did it, but a sucker is born every day. Can't wait till she dishes out his next delinquent back pay. He is from MO and she lives in Canada. Missouri won't do anything until 10,000.00 behind, I use to know TXs ruling but I forget, but I know TX's is a more aggressive law.

You could get a job, that would help you short term. Then you need to take him to court so that the judge can order child support. ONce the order is in place, the state will contact his employer and instruct them how much to take out of his check.

Take his @ss to the cleaners, and get whatever you can get, and don't let him talk you out of it, or make verbal arrangements or agreements, put it on paper and have a judge sign it. Your children deserve everything that they are "entitled" to. Good Luck and God Bless.

File for divorce! Declare it his fault for adultery (and possibly abandonment, though you would have to see the statutory definition of abandonment in TX). Go see an attorney.
