If she gets a restraining order against you, then it is determined that there will be no sex between the two of you.

Seriously, in humans, it is the Y chromsome that determines if you are a male. If you don't have it, you're a female. Note also that sex determination is different in different organisms.

In humans, the father determines the sex. If the offspring has a Y chromosome, it is male. A male has one X and one Y, so the father can give either one. A woman has two X chromosomes, so she can only give the offspring an X.
A male child receives an X chroomosome from his mother and a Y from his father. A female child has received an X from both mother and father.
