He needs to pay the money back. It's the only right thing to do. Why should he get to keep money that isn't his? He would have caught the error if he had balanced his checkbook against his monthly statement. I find it odd that he caught the error when not enough money went in and never followed up to make sure the correct amount was deposited. If he had, he would have known they deposited the wrong amount and he could have rectified it 3 months ago. Shame!

You legally are responsible to pay for the excess. Remember that even if you have direct deposit, if that deposit comes on Friday afternoon, it is not credited to your account until Monday morning (3 days later). It does not matter if thier mistake put more money into your account, you still owe them the money. How do you think you are entitled to free money from the bank?

You expect them to take responsibility for their faults but he also needs to take responsibility for his fault of not catching the over payment and if he spent it that was just even more wrong. They were going to catch up to it eventually, there was no hiding something like that. If he were to bounce a check by going over because of their error then they should pay the fees, but they still get their money back.

You answer the question yourself. You're upset when they put the deposit in as $0.01, you want it to be correct. Now they give you more money and they want to be correct and now you're fighting for it to be incorrect, which is completely against your original argument. What makes you think you should be entitled to money that is not yours anyway? The bank made errors, make it right by the bank. They have every legal right and responsibility for the deposit to be the correct amount.

At least they caught it within 90 days. Something similar happened to me only it took them 3 years to catch it. I refused to pay back and they wrote it off.
Granted it's not your boyfriends fault the bank goofed, but to stay in good standing he should payback the difference. You could always talk to a lawyer to see if there is anything you can do about this.

You're right, it wasn't his fault, but it wasn't his fault that they underpaid him the first time. He was entitled to the amount on the check; no more, no less. If the bank gave him more, he must repay it.

your boyfriend lied. he TOLD you that he put that money in, but in reality he spent it on porn and hookers. Then he formed this elaborate story about where it went so you wouldn't find out.
But he said it was the best weekend of his life, and well worth the trouble.
