And his reasons are exagerated or a lie? He justs wants a quick divorce. He is on a formal police caution for assulting me too. Can he still claim money from me with a history of violence behind him with me?

If you're in the UK, this is not unlawful behaviour but unreasonable behaviour. It makes no difference to any other aspects of your divorce but you should get some advice from a solicitor. It sounds as if you would be best off allowing his petition to proceed and you can state on the Acknowledgement of Service form "I do not accept that I have behaved unreasonably but I consent to the granting of a decree". Your solicitor will want to see the actual allegations; he can if he thinks fit write to your husband's solicitors suggesting that if the allegations are amended you will allow the petition to proceed, but stating categorically which of them are untrue.

It really is best for you to take the papers to a solicitor. Look in the Yellow Pages for your area and find a firm of solicitors that says it deals with divorce. Some offer a fixed fee interview, and some offer a free half hour consultation. Alternatively you can see a solicitor free at a session at your local Citizens Advice Bureau but it may take a while to get an appointment and you're really supposed to return the Acknowledgement of Service form to the court within 8 days.

Don't mention anything to your husband about having received the petition. This means not referring to anything that is in the petition. Make sure you get advice from your solicitor first.

In most divorces reasons given are exagerated, I wouldn't imagine his history of violence would remove any rights he may have acquired during the marriage but a judge may take that into account.
