i caught a really bad sore throat friday morning. it got worse over the weekend. called in sick monday to go to the doctor and was diagnosed with strep. i felt better yesterday after my 2nd day of antibiotics and went with my fiance and son to the mall for maybe 30 minutes. while there, i spotted the head boss from my work but she didnt see me. well, thanks to not resting yesterday i feel like crap today and had to call in. we have been advised that thanks to HIPAA we dont have to state a reason why we are calling in sick so i didnt. also, i still have plenty of sick time in my bank. question is, if she did see me out does she have any leg to stand on? she isnt at my house right now and cant prove that my throat isnt still killing me. i work for a major medical insurance company in customer service and am on the phones 90% of the day which isnt great for a sore throat. thoughts?

Well, at some companies, bosses can fire people at their discretion. However, Even if she saw you out and about, they would have a hard time firing you because even when you are sick, you still have to go out sometimes (to go to the drugist to get scrips filled, get cough drops, etc.), and probably 99% of employers would understand.

EDIT: Yes... a note from the doc explaining your absence is *always* helpful. Most employers won't need one, but it never hurts to provide one.

There are a variety of things wrong here. If you are required to be there at 5, then they should be paying you from 5 even if they don't have you start working until 6, assuming that you are not allowed to just come in at 6. Another thing wrong though is your attitude - the attitude that everyone but you is an asshole. Even if there's some truth in it, and that's very possible, your attitude likely shows at work, and you won't get any respect either. And "you guess" they didn't mind that you took off on Sunday? That's a very poor attitude. That said, yes they can legally fire you for calling off even if you hadn't just been off for the whole weekend..

I usually would get a note from my doctor just to prove I was sick.
As to being seen in public I have often lived alone so my question is who's going to drive me to the doctor? And what if I have to go to the drug store and my boss sees me? Sometimes it's necessary to go out to get something. Maybe you could say you were still were not well and didn't want to expose your co-workers.

Legally, most states are 'at will'. That means that an employer and employee have a right to terminate their relationship at any time without reason. If your boss wanted to fire you, she could, and would not have to state a reason. Neither side is required to give notice.

It really depends on the laws in your state but here in NY yes you can be fired for calling in sick. Especially if you were seen at the mall.

in "right to work" states you can be fired for anything or nothing, as you can quit for anything or nothing. In other states there may be protective state laws. As you saw a doc should not be tough to get a note from him or her attesting to your illness, which might help if theres an issue.
