i am pregnant(just found out yesterday, and i assume i am about 7 weeks). My position is material controls for an automotive parts supplier. I ship and recieve, using a walk behind high-lo. I also do inventory control and most office duties. i think being pregnant will effect my ability to use the high-lo, other wise I can do everything else. this is a SMALL company. just me and the general manager, so there is nobody else to do my job when I take maturnity leave.

If any one knows the laws on this I would appreciate some advice...thanks

While it is a small company and the employer cannot hire someone to do the work you do when on maternity leave and when not able to perform your duties you may be let go but in this instance you would be eligible for workers unemployment benefits.◙

Since you are the only employee, you are not protected - in a larger company, you could not be terminated for being pregnant. In this case, because keeping your job open while you are on maternity leave would cause undue hardship, your employer is entitled to replace you.

I don't know where you live but many states in the USA are "at will" states. This means you can be terminated any time for any reason or no reason. You may also quit any time with no notice or reason. Morally I think firing you because of your preganacy is wrong, it may happen and I suppose you could file a lawsuit but unless your employer puts it in writing or you have a video or audio tape good luck with that. They may just fire you and not fight your collecting unemployment insurance if you are eligible.

Depends on your employer's benefits, however I don't think it is legal for them to fire you only because you are pregnant.
