this lady was looking out of her window, when a 30 year old man was walking in her yard, he asked her what the hell was she looking at? She said i've got a right to look out of my window and went out side, he tried to jump on her until she pulled the gun out, then he left, and told her he'd be back. The cop's came after she called 911 but they couldn't find him. He got mad at her for looking out of her own window, at him walking in her front window of the apt. complex? if he'd beat her would she be justified in shooting him?

I believe it is always against the law to shoot someone as an act of retaliation. However, there is the possibility that she can prove in court that she did it as an act of self defense, that she feared for her life, that the only way she could prevent him from beating her to death was to shoot him. All this is possible, but very very difficult because if one person has a gun and the other is unarmed, the prosecutor can just keep hammering away at the defense that the shooting was unjustified and was an excessive use of force. However, I feel in my heart that any man who beats a woman deserves to be shot and after she shoots him once, he probably won't be beating on her again. In Florida, where it is legal for women to carry guns in their purses, there are many cases of attempted robbery, or attempted rape, or attempted car-jackings, or attempted beatings, but in most of them the woman pulls out her gun and blasts the perp. If these cases make it to court, the women almost always win, because Florida courts look upon these as simple "self-defense". This has had a profound positve affect on crime rates against women.

You can't shoot people after the fact. If the woman shot the man during the beating chances are she might get away with it as long as she had a reasonable cause to assume that the man ment to kill her. Then again if she shot the guy and no one knew about it.

The age is immaterial. If she shot him while he was beating her, it would likely be judged self-defense. If she does it as revenge, after the beating, then it's at best manslaughter.

You cannot take retribution against someone in a civilized society - that would lead to mob rule, where no-one would be safe.

Because she is taking the law into her own hands.

She can defend herself, but nothing more.

She could shoot him if he was attacking her with a deadly weapon, she was in fear for her life, and had no way to retreat.

I don't know the story but I think that she should have every right to shoot the S O B that is harming her.I"m sure that it is legal to use whatever force is needed to protect yourself..I think there should be more of this "shooting"going on!!

Because murder is a felony regardless. I don't know the situation but if she had killed him while he was attacking her then it could be self defense. But that depends on how many times she shot him.
