I am recently married for the second time and it feels as if it were my first.
I am in love, I made the best decision ever in my life to marry this man. Five years ago, I was married to someone else. To make a long story short, he cheated on me within 3 months of the marriage, and I left him. Since then i have tried to find him so i can divorce him, but never found him. At this time i am not in the financial means to pursue the divorce and I married my husband Jose.
I have great guilt in the back of my mind...Did i commit bigamy? I read about this on the internet, and they speak of con-artists... this is not me. And if i did, what is the punishment? Will my marriage be annuled?
Serious answers only...and from people who know what they are speaking of...thank you!

Yes You have to be legally divorced of which you can do Pro Se with a book from the Bookstore. File it yourself following the book instructions..even citation by publication ..since you can't find him. Some even have a Paupers Oath which you file with it as to the ability to pay. all this can cost from my experience from $58-$120. Wait the 30 waiting period after the judge signs the Decree, and then get license get married its legal.. James Browns wife had a problem because she was in the same shoes as you got married to James Brown but it wasn't legal.. if the previous marriage is still in force. She couldn't even get into her own house. Follow the law and you will be good. Get an attorney , or call Prepaid Legal 1-800-654-7757 toll free. I get nothing for this.. no referral fee. I am a prepaid legal member. God bless you efforts to get things right!

Yes, you've broken the law. Your new marriage will be annulled when found out.
You should have filed for divorce a long time ago. If the guy doesn't respond for a certain amount of time, it is considered uncontested and the divorce becomes final.
You are going to have some serious problems when it's time to buy a house, file taxes, etc.

Yep! It is illegal in the U.S.A. to be married to more than one person at a time. I think this even supercedes religious convictions (as in Mormons who used to practice polygamy). If you could not find your husband for 7 years, then I believe that there is a stature that considers them dead. You would probably be off the hook then, however, only 3 years has passed. And, that is, after 7 years missing, you could marry legally again. You may want to consult with legal counsel since you did make attempts to locate your ex but were unsuccessful. Now, the question is, how hard did you look for him??? hire a private detective? etc. internet search utilizing people search, etc.?
I'm glad you found your Mr. Right. Good luck to you.

I don't really NEED to throw in my $0.02 - but here it is anyway:
Bigamy is defined in Wikipedia as follows:
Bigamy is when one individual is married to two people at the same time; a person doubly married is a bigamist. Many countries have specific statutes outlawing bigamy, making any secondary marriage a crime.
Note that these laws aren't limited to cases of traditional polygamy, where the spouses know about each other. They also cover cases such as a man who breaks up with his wife, and without divorcing her, marries another woman. It even covers the occasional case of a man who sets up a second family with a second wife, keeping his dual marriage a secret from one or both of them. In both of these cases, the effect of these laws is to protect people from being married under false pretenses.
The following text is from the Danish version of the same definition (translation follows):
I Danske Lov fra 1683 om polygami står skrevet følgende:
Hvilken Ãgtemand eller Ãgtekvinde, der indlader sig med en anden i Ãgteskab, bør at miste sin hals.
Translation:
In "Danske Lov" (the name of the law is "Danish Law" - the original law in Denmark, dated 1683) from 1683 of poligamy the following is written:
Any husband or wife that partake themselves with another within marriage, ought to lose their neck.
Yes, you are a bigamist, and you are committing a crime. However, you will likely not be beheaded for it...

Absolutely. Assuming you are in the United States, your second marriage is not legal. This could affect spousal support if you were to ever get a divorce, as well as Social Security and Medicare as you age. You could also be prosecuted, and you are committing fraud if you are getting (or he is getting) any benefits from an employer. If you file joint taxes, you could also be violating tax laws.
