What are possible legal reprocussions, ect ?

The error will eventually be found and you will be liable for paying it back. If the amount were small, it is highly unlikely that you would face any legal problems. For this large amount, however, you could be in legal trouble if you did not report the error, as it would be obvious that you knew it was an error.

Many people think that if the bank makes a mistake in your favor that you can go ahead and use the money. In actual fact, a number of people have been prosecuted for using money mistakenly credited to their account that they were aware was not actually theirs.

They will discover the error sooner or later and they will demand that you return the difference. If you don't come forward with the difference, you may not be able to collect disability in the future.

Well, once they figure out that they overpaid, they will ask for the $5,000 back so you are better off mentioning it.

They will find the mistake eventually and you will have to pay it back. Call them and let them know. To me, if you keep it, it is as good as stealing.
