As someone who has been in the teaching profession for many years, I hope you go with the more traditional spelling of "Clay," or "Clayton." For many years I have seen kids pay the price of their parents' attempts at individuality by coming up with "creative" spellings. You can tell they have spent their whole lives explaining that no, their name is not spelled the way one would think. If you want to be unusual, pick an unusual name ("Camden" or "Clement") instead of misspelling a traditional name. Besides, in this case, both "Klay" and "Klayton" look like names from Superman's home planet of Krypton---that or the name of someone the crew of the Enterprise would fight on one of the Star Trek episodes.
Furthermore, I would suggest "Clayton" as my first choice. Then the child always has the option of choosing the shorter nickname if he chooses, or using the longer, more formal name if that is his preference or suits his purpose when he goes to law school. If you give him the shorter name to start with, he's stuck with it.
A nice, traditional middle name also sounds elegant "Clayton James" or "Clayton Michael" would be nice--and would give him other name options if he chooses them in later life. Whatever you do, try to avoid alliteration: "Clayton Christopher" or "Clay Kim."
I don't mean to sound stuffy, but I'm speaking from the experience of naming two boys myself a couple of decades ago. We chose longer, traditional names. Interestingly, the boys prefer to be called by those names by family and girlfriends, and by nicknames by less close friends.
