Brand new $60K garage, part II. Started having serious humidity and ice build up (reside in cold climate -10 degrees below 0 today) in my brand new heated and insulated 26 X 30 garage. Ice formed on the wall interior between the ceilings and wall. Humidity was always running high in the garage etc. Called a building inspector out and he crawled over everything and found two problems. The builder never baffled off the insulation near the eve and the ridge vent was covered and blocked by insulation. The insulation had pushed up in many spots along the roof sheathing and therefore between this and the ridge vent being blocked, no airflow circulates through. The inspector wrote up the report and my builder said he would take care of it when he could!

1. My warranty of this garage is over in 45 days, so do I demand he finish it by then, or will he still be legally bound if he does not? To me warranty implies the structure was built right, this was not?

2. will there be insulation damaged due to ice and moisture buildup?

3. In my attic, it will take 30 hours of my time to remove and replace storage items so he can do his job there. Can I charge him for this? This builder is a pure BSer and borderline con-man. I'm through being "nice" about these things. Also, should I bill him for the inspection. It's the third one I've had to have now due to HIS fricken mistakes.

ur inspector is correct.....there should be a min. of 1" of air space between the top of the insulation and the roof....this is ur air space that moves the air out of the rafters.....as a lic. gen. contractor, yes i would be pissed at the contractor but i would also be asking the question ' how did this pass inspection thru the building dept. ?"

the contractor u used should be lic.... if not anything over $30,000.00 he is not covered on...if lic. contact the lic. board in ur state.they should handle it from there....

contract the local building inspector and find out if he took out a permit..if not tell them u want them to press charges on him for building with out a lic......its a law in most states and a big fine....

then tell ur contractor/builder he has 72 hrs to start and another 72 hrs to complete the work or u will have it done by a lic. contractor and he will be billed and sued for the work....

also contact the local distract attorney and ask him of ur options...

I recommend putting in a dehumidifier for the short term. You can not bill the builder for the stuff you put in to the attic... but you can refuse to pay him for repairing the damage because the inspection took place before the warranty was up.

I have a question, Does he have all his money?
Do u have a contract with him?
Did u get more than one bid?
Did u check his references, BBB, insurance coverage?
Besides the garage heated, (what 2 1/2 ton unit?) what is in it? It sound a little high per sq cost.
