I'm 8 mos pregnant and am positive I don't want to return. If I tell them before I go on maternity leave does that jeopardize my disability or paid family leave benefits? (I'm a California resident)

I would wait until 2 weeks before you were going to return to work. That way you are giving 2 weeks notice. I would be afraid that if you give notice now you may not get paid while on maternity leave and you might lose your health benefits as well. I am not sure what the exact laws are in CA or anywhere else! It would also depend on whether you really care about your employer, the size of the company, and if they have been good to you.

I read in a magazine that if you don't return for at least 30 days of work than the company has the right to sue you for any "leave" pay that your received and possibly medical coverage they paid while you where out on your leave. As long as you return for 30 days of work then by law you are entitled to all the benefits you received while on your leave.

I can't remember which magazine I read that in, either Parents, or Fit Pregnancy, or Pregnancy.

If you want to get paid time off, I think you would have to return and put in your two week notice. Then collect your maternity leave. I would check what your HR director and find out what your policies are for you job.

To get all benifits I wold return to work for a day or two after the maternity leave and then quit

I would wait until you go out to tell them for sure. Just let them know that you've decided that the best thing for your family is to stay home with your child. You may want to consider mentioning it to them that you are considering this. They can't fire you for it.

I live in Florida though, so I don't know about the laws in California. You should be able to get a copy of them from your employer.

Sticky situation. If you have vacation pay coming to you, then you should get that. Otherwise, if you quit your job, I would assume you are not on a maternity leave but you have simply quit your job. So no benefits. I would seriously discuss this with your employer. I don't know him/her, but I know as an office manager, it is greatly appreciated (and well respected) when people are honest about such situations.

Most likely it does affect your benefits. They may consider your last day before you take maternity leave as your dismissal, and then you won't qualify for benefits while you're recovering from childbirth.

don't tell until after you get all you medical covered by your insurance, then tell him at the last minute you won't be returning. like 2 weeks before you are due to return - that is just like giving your 2 weeks noice

dont tell them until your leave is up, make it sound like a last minute decision, based on finances, my sil got fired while on leave because of it, and she had no recourse they made up an excuse.
