My fiance is currently on probation for felony sposal abuse. He is not supossed to contact his ex although he has a son with her. He is ordered to be on probation for 4 yrs and has completed 2 yrs and is up for early dismisal. She has been contacting him via email and informing him he is a horrible father for not being around for his son. *Problem is he is ordered not to make contact! She is threatening to have his parental rights revoked. My fiance is really hurt! He loves his son and wants him to be a complete part of his life! We can't contact her or respond because it is against his probation. She is also saying her husband would love to adopt his son considering (my fiance) doesn't want anything to do with him. "NOT TRUE!" WE...want to see his son!! But, he is not suposed to make contact....What does my (fiance) do???

Do not, I repeat do not break the law. He can go to jail. hire an attorney to petition the court for supervised visitation rights. I mean this. I know the law, first hand and I know what it is like to want to see your son. Be cool, your son loves you. You will always be in his heart and he is in your heart. Have a little patience. Chances are if you had patience you would not of been charged by the witch.

Her fiance can't adopt him without your fiance's approval. #1, He should have never hit his ex, but no use crying over spilled milk. I hope he's gotten over that now. #2, When his probation is finished, then and only then can he attempt to contact his son. So make sure he saves all court orders and proceedings on paper, he may have to show that to his son at a later day.#3 Eventually his son will seek him out when he gets older, and find out he's got a real dad that loves him....so patience is the key. Tell him not to sweat things........Best of luck to you.

Has he tried going to family court or whatever court has jurisdiction over these matters in your area and petitioning to have the order revisited so that he can request a revision. He should try contacting a father's rights group in your area or via the Internet if he cannot afford an attorney of his own. He should definitely try to make sure that his parental rights are clearly established before the other party petitions to have them revoked.

My guess would be that the best thing is to contact a lawyer or something to try to get the court order changed.

If he just ignores the court order it will look pretty bad, but if he goes about it the proper way it's a better chance that he might get things changed.

Make copies of the emails she has sent. Take them to the probation officer and tell him/her what she is doing. He will need some legal counsel on this, as it sounds as though she is being very nasty and is trying to get him in trouble. Spousal abuse? Sounds like she's the one who ought to be in jail. Using a child to bargain for stuff or to get even with someone is just the lowest. I have no time or patience for such people. I wish your bf luck, and you too. You'll need a lot of patience.

nothing he really can do but turn to the law. if he breaks his probation yes he can loose his parental rights. and filing for custody will not work because the judge will not go for it because he has felony charges. the best thing for him to do is contact an attorney who specialize in family/child law. that way he may get to have specific visitation rights (i.e.weekends, certain holidays...etc) good luck!

That's kind of silly that he cant contact her, but she can harass him. First thought maybe u could go get his son and bring him to see his dad, baby momma might not like it.Second thought, Seek free legal help or some kind of help, just ask them how you should go about it, so you don't do anything wrong in the best interest of the son.

Print out the emails and take them to a lawyer. Tell him that these emails are inciteful. They are sent with the intention of making him break the court order. She may find herself in more trouble than those emails are worth.

Sounds like the son's mother is baiting him. He should talk to someone at family court. Let him work this out, don't get sucked into problems you didn't cause.
